Terms of Service

1. Acceptance of Terms

By creating an account or using Noctra, you agree to these Terms of Service and our Privacy Policy. If you don't agree, please don't use the app.

2. Eligibility

You must be at least 13 years old to use Noctra, and you must be able to form a binding contract in your jurisdiction. Noctra is intended for a general audience; we don't currently operate an age-verification system, so we rely on you providing accurate information.

3. Your Account

You're responsible for maintaining the security of your account and for all activity under it. You agree to provide accurate information, including your chosen username, and to keep your login credentials confidential. Notify us promptly if you believe your account has been compromised.

4. What Noctra Provides

Noctra is a focus and digital-wellbeing app that includes:

• Focus Sessions — timed, protected sessions in Work, Sleep, or Detox modes.
• Guardian Protection — app/website blocking during sessions and scheduled Focus Blocks, powered by Apple's Screen Time frameworks, in Standard or Locked mode.
• Focus Blocks & Plan — recurring scheduled protected time windows and goal/task tracking.
• Ascent — a visual progression system that reflects your focus activity over time.
• Crew — private, connection-based accountability with friends you choose to add, including live focus presence and Focus Together.
• Check-Ins, Meditation & Recovery — optional wellness-support tools for logging mood/reflections and guided breathing resets.
• Insights — analytics on your own focus activity and app usage.

5. Platform Limitations

Guardian protection depends on Apple's Screen Time permissions and frameworks, your device's configuration, and iOS behavior generally. We work to make protection as reliable as possible, but we cannot guarantee it will block every attempt in every circumstance, especially if required permissions are revoked or the operating system behaves unexpectedly. You're responsible for granting and maintaining the permissions Noctra requests.

Notifications, Live Activities, and Dynamic Island features depend on your device settings and may not always be available or timely.

6. Subscriptions (Noctra Pro)

Noctra Pro is offered as an auto-renewing subscription through Apple's In-App Purchase system, currently at $5.99/month or $44.99/year (prices shown at time of purchase are authoritative and may vary by region or change over time). Subscriptions renew automatically unless canceled at least 24 hours before the end of the current period. You can manage or cancel your subscription anytime through your Apple ID account settings. Refunds are handled by Apple according to their own policies — we don't process payments or refunds directly.

7. Free vs. Pro Features

Noctra offers a genuinely functional free tier. Certain features are reserved for Pro subscribers, including (and subject to change as the product evolves): Locked Guardian mode, additional Focus Blocks beyond the free limit, additional custom shield messages, AI-assisted session timing and proactive reminders, continued Ascent progression beyond the free tier, streak freeze allowances, additional Crew connections beyond the free limit, and Focus Together history.

8. User Conduct and Community Standards

Crew lets you connect privately with other users you choose. By using it, you agree not to:

• Choose a username, profile detail, or shared content that is offensive, harassing, impersonating, or otherwise objectionable.
• Harass, bully, threaten, or abuse other users through any feature of the app.
• Attempt to access another user's account or data without authorization.

We have zero tolerance for objectionable content or abusive behavior. We reserve the right to remove content, suspend, or permanently terminate any account that violates these standards, at our sole discretion.

9. Reporting Concerns

If another user's behavior or content concerns you, you can report them directly in the app: select Report from that member's Crew actions and choose a reason. After submitting a report, you can also block the reported account. Blocking removes Crew connections and pending requests, and prevents Crew discovery, focus presence, friend requests, and Focus Together invitations between the two accounts. You can review and unblock accounts anytime under Settings → Privacy → Blocked Users. You can also contact us at noctraproductivity@gmail.com for any safety concern. Reports may be retained and reviewed for safety, enforcement, and legal compliance purposes.

10. Not Medical Advice

Noctra's check-in, meditation, and wellness features are productivity and self-reflection tools — they are not medical, psychological, or emergency services, and Noctra is not a substitute for professional care. If you're experiencing a mental health crisis, please contact a qualified professional or your local emergency/crisis services.

11. Intellectual Property

Noctra's design, branding, illustrations, and underlying software are owned by us and protected by applicable intellectual property law. Your own content (goals, check-in entries, and similar personal data) remains yours — using the app doesn't transfer ownership of your content to us, and we don't claim any license to use your personal reflections or check-in content beyond what's needed to operate the app for you, as described in our Privacy Policy.

12. Disclaimers

Noctra is provided "as is" without warranties of any kind, to the extent permitted by law. We don't guarantee the app will be uninterrupted, error-free, or perfectly effective at blocking every distraction in every circumstance.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Noctra and its developer aren't liable for any indirect, incidental, or consequential damages arising from your use of the app. Nothing in these terms limits liability where it can't legally be limited.

14. Termination

You can stop using Noctra and delete your account at any time through Settings. We may suspend or terminate your access if you violate these terms, at our discretion.

15. Changes to These Terms

We may update these terms from time to time. If we make material changes, we'll notify you through the app. Continued use after changes take effect means you accept the updated terms.

16. Governing Law

These terms are governed by the laws of the Province of Ontario and the applicable federal laws of Canada, without regard to conflict-of-law principles. If you're located outside Canada, nothing in these terms limits any statutory consumer protection rights you're entitled to under your local law.
